Enduring Powers of Guardianship
Enduring Powers of Guardianship (EPG)
Empower the right people to speak for you
An Enduring Power of Guardianship (EPG) lets you appoint someone you trust – a Guardian – to make decisions about your health, lifestyle and medical care if you’re ever unable to make those decisions yourself.
It’s about having someone in your corner to speak up for your wishes, when you can’t.
What can a Guardian decide?
Depending on your instructions, your Guardian may be able to:
- Decide where you live and who you live with
- Give or refuse consent to medical treatment
- Make decisions about your lifestyle and daily care
- Help ensure your wellbeing, comfort and dignity are protected
You can also limit their powers or provide specific directions about how decisions are to be made, giving you control even when you’re unable to speak for yourself.
When does an EPG take effect?
Your EPG only becomes active if you lose the capacity to make reasonable decisions about your own welfare. That determination may be made through a medical assessment or by the State Administrative Tribunal (SAT).
How many Guardians can you appoint?
You can appoint one or more Guardians, but under WA law, they must act jointly. That means they must always agree on decisions and act together.
We’ll help you choose people you trust and talk through how they can best support you.
What responsibilities does a Guardian have?
Your Guardian must:
- Always act in your best interests
- Respect your values, preferences and dignity
- Follow any instructions you’ve outlined in the EPG
- Comply with their legal duties under the Guardianship and Administration Act
TLS offers clear advice for Guardians so they feel confident in their role, especially in emotionally difficult situations.

How TLS can help with your EPG
We support clients and families across WA by:
- Preparing clear, tailored EPG documents
- Advising Guardians on their duties and decision-making responsibilities
