SAT Applications
State Administrative Tribunal Applications
The SAT is an independent, statutory tribunal which has jurisdiction to:
- Consider applications for guardianship and administration orders;
- Make orders appointing, and as to the functions of, and for giving directions to, guardians and administrators;
- Make orders declaring the capacity of a represented person to vote at parliamentary elections;
- Review guardianship and administration orders and to make orders consequential thereon;
- Give or withhold consent to the sterilisation of persons in respect of whom guardianship orders are in force;
- In relation to powers of attorney that operate after the donor has ceased to have legal capacity; and
- Deal with any other matters in relation to guardianship and administration vested in it by the Guardianship and Administration Act 1990 (WA) (the “Act”) or any other Act.
The SAT is generally a “no costs” or “costs neutral” jurisdiction. There are no costs for filing applications under the Act or for hearing such applications. Generally, each party will bear their own costs in respect to applications and hearings, however the Act allows SAT to award costs if it is satisfied that a party has acted in the best interests of the represented person.
The SAT aims to be informal and accessible to parties, however we are commonly engaged by parties to assist with the following applications made under the Act:
- Section 106 – made by an Attorney of an EPA seeking an order declaring that the donor of an EPA has lost capacity, and that the EPA is in force.
- Section 40 – made by an interested person for an administration order and/or guardianship order over a person who has lost capacity.
- Section 109 – made by an interested person seeking an order requiring an Attorney of an EPA to file with the SAT records and accounts of dealing and transactions made by the Attorney under the EPA.
- Section 109 – made by an interested person seeking an order revoking or varying the terms of an EPA.
