Our Services

Administering a deceased estate involves legal responsibilities. TLS offers Probate services to help executors manage and distribute estates according to the law.

Did you know?

Superannuation is not part of the estate

This depends on the circumstances and whether there is a valid Binding Death Benefit Nomination in place.

Probate isn't always required

Depending on the complexity of the estate and the deceased's assets, Probate isn't always needed. We recommend seeking legal advice first to see if Probate is required for your matter.

6-8 Weeks

Is how long it takes to receive the Grant of Probate after filing the application with the Supreme Court of Western Australia. This process can be streamlined depending on the urgency of estate administration.

I was recommended Natale by name by another firm that specialises in estate and trust law, who assured me I would be in good hands — and I was. From the very beginning, Natale and his team have been superlative. The team at TLS are extremely resourceful, efficient, fast, concise, accurate, compassionate, and, most importantly, sensible.

Frequently Asked Questions.

A Probate lawyer guides executors and beneficiaries through the legal process of settling an estate – from filing applications for Probate or Letters of Administration, to resolving creditor claims and distributing assets.

Professional fees vary on the complexity of the estate. A standard, uncontested application handled by an experienced probate lawyer typically ranges between $3,000 to $4,000+, depending on the complexity of the Will or family dynamics. In addition to professional fees, the Supreme Court of WA has a filing fee for Probate applications of $418.

To apply for Probate, we will require the original Will of the deceased along with the original Death Certificate and a statement of the deceased’s assets and liabilities, as at the date of death.

If you are unsure how to prepare the statement of assets and liabilities our team will assist you with this.

Yes. We represent both executors defending a Will and parties challenging its validity. Our team handles undue influence claims, capacity disputes, and mediation to reach fair resolutions.

If an individual passes away without leaving a valid Will, or if the named executor is unable to act, the family must apply for Letters of Administration instead of Probate. This legal document, granted by the Court, authorises a personal representative to handle assets, settle debts, and ensure the estate is distributed according to the rules of intestacy.
